TERMS AND CONDITIONS

1. ACCEPTANCE & SCOPE

These Terms and Conditions (“Terms”) apply to all bookings, quotations, and services provided by Holy House Travel (“we”, “us”, “our”) to you (“Client”, “you”, “your”). By making a booking, paying a deposit, or confirming an itinerary, you agree to be bound by these Terms, including all applicable laws and supplier conditions.

Governing Legislation: These Terms comply fully with:

  • Australian Consumer Law (ACL) – Competition and Consumer Act 2010 (Cth)
  • Privacy Act 1988 (Cth) & Australian Privacy Principles (APPs)
  • Electronic Transactions Act 1999 (Cth) & state equivalents
  • Fair Trading Act 1999 (Vic) and relevant state consumer laws
  • Smartraveller guidelines (DFAT) for safe travel advice

2. BOOKINGS & CONFIRMATION

Agent Role

We act as an intermediary/booking agent, not the service provider. Flights, accommodation, tours, transport, and insurance are supplied by third parties, whose own terms apply alongside these Terms.

Bookings

All bookings are subject to supplier availability and final confirmation. Quotations are valid for 24 hours unless stated otherwise.

A booking is only confirmed once we issue a written confirmation (email/voucher) and receive the required deposit or full payment.

Name Accuracy

You must provide full, correct names matching passports or any approved travel documents. If the incorrect name was provided by the travel arranger/passenger, change fees and/or forfeit of fare (based on supplier policies) may apply. Admin fee of AUD100 is to be paid to Holy House Travel.

Visa

It is the responsibility of the traveller and not the agent, to make sure that all Immigration/Visa requirement of the destination of travel is adhere too. We are not responsible for any supplier cancellation or refusal of boarding if it’s related to this clause.

Confirmation

Confirmation itinerary/vouchers will be emailed directly to the provided email. Some confirmation may take time to come through depending on the supplier process.

3. Payment Terms

Currency: All prices are in Australian Dollars (AUD) unless clearly stated otherwise.

 

Surcharges: Credit card, bank, and foreign exchange fees apply as disclosed at booking. No hidden fees under ACL requirements.

 

Price Changes: Prices are always subject to changes until full payment and final confirmation has been issued.

 

Payment Methods: We accept Cash, Credit/Debit Card Payment and Direct Deposit. Information will also be included in your invoice of service.

 

4. Cancellation and Refunds

All cancellations and refunds are based on each product and cancellation conditions set out by the supplier. Holy House Travel do not have any control on suppliers’ conditions. Holy House Travel can process cancellations and request for refunds if applicable, however the process and timeframe are at the discretion of the supplier. Administration fee of AUD150 will be added on top of the supplier cancellation/refund fees by Holy House Travel.

Please note, refunds takes between 7 to 14 business days to be processed once Holy House Travel receive the refund from the supplier. Subject to your financial institution process.

5. Client Responsibilities

Travel Documents: You are solely responsible for obtaining valid passports (minimum 6 months validity beyond return date), visas, travel permits, health certificates, and meeting all entry/exit requirements of the countries visited. We provide general advice only and do not guarantee entry.

Health and Insurance: You are strongly advised to purchase comprehensive travel insurance at the time of booking, covering cancellation, medical expenses, emergency evacuation, loss of luggage, and travel disruptions. We recommend reviewing advice at Smartraveller.gov.au.

Compliance: You must follow all rules and instructions of airlines, hotels, tour operators, and local laws. You are liable for any fines, penalties, or costs arising from non-compliance

6. Liability and Force Majeure

Statutory Rights: Your rights under the ACL cannot be excluded, restricted, or modified. This means you are entitled to remedies if services are faulty, unsafe, or not delivered as promised.

Limitation of Liability: Where permitted by law, our total liability to you is limited to the amount of fees we have charged for our services. We are not liable for losses arising from acts or omissions of third-party suppliers.

Force Majeure: We will not be liable for delays, cancellations, or failures caused by events beyond reasonable control, including but not limited to: natural disasters, pandemics, strikes, civil unrest, border closures, government orders, or extreme weather. In such cases, we will work with you and suppliers to arrange refunds, credits, or alternative travel where possible.

7. Privacy

We handle your personal information in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles. Details are set out in our separate Privacy Policy.

8. Privacy Policy

This Privacy Policy explains how we collect, use, store, and protect your personal information, in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

  • Full name, date of birth, contact details (address, email, phone)
  • Passport and identification details
  • Payment information
  • Special requirements (dietary, accessibility, medical needs)

We use your information only to:

  • Process and confirm your booking
  • Arrange services with airlines, hotels, and other suppliers
  • Send travel documents, updates, and confirmations
  • Comply with legal and regulatory requirements
  • Improve our services

We share your information only with:

  • Third-party service providers required to deliver your travel arrangements
  • Regulatory or government authorities where required by law
  • We do not sell, rent, or trade your personal information to third parties for marketing purposes.

We take reasonable steps to protect your information from loss, misuse, or unauthorised access, using secure storage and encrypted communications where possible.

  1. YOUR RIGHTS

You have the right to:

  • Request access to the personal information we hold about you
  • Request corrections if information is inaccurate or incomplete
  • Request deletion of information, subject to legal record-keeping requirements
  • Lodge a complaint if you believe your privacy has been breached, by contacting us or the Office of the Australian Information Commissioner (OAIC).

9. Fee Structures

Please note that the service fees below are additions to any fees charged by individual suppliers ie: airlines, tour operators, accommodation provider, car higher, travel insurance and much much more.
